Frequently Asked Questions About Marijuana Usage In Colorado

Colorado s innovative recreational marijuana laws are an exciting experiment in social policy that have captured the attention of the entire world. With great power comes great responsibility though, and law enforcement officials will be aggressively cracking down on illegal possession and stoned driving to make the rules clear as the drug becomes more prevalent. In order to better understand our state s groundbreaking legislation, here are my answers to some of the most commonly-asked questions especially in regards to drug-related driving offences.

First and foremost, the basic rules of legalized recreational marijuana drug use are:

Coloradoans may only possess or purchase 1 ounce of marijuana at a time.

Smoking, vaporizing, or consuming cannabis in public places (i.e., Red Rocks; Coors Field; 16th Street Mall; parking lots; or airports) is absolutely forbidden.

Driving under the influence of marijuana is illegal.

So, all Coloradoans can use marijuana for pleasure now?

Correct–to an extent. All legal residents of Colorado 21 years and older may possess, use, display, purchase, or transport 1 ounce (nearly 60 joints) or less of marijuana for recreational use. However, several cities and counties have passed their own amendments to make things such as marijuana growing facilities or retail pot shops illegal (here s looking at you, Colorado Springs, Westminster, and Centennial!). Similarly, your employer has the right to create his or her own policies regarding marijuana use amongst employees even in the privacy of their own homes.

Since marijuana is legal in Colorado, petty drug offenses aren t that big a deal anymore, right?

This is a common misconception. The federal government still considers marijuana illegal, which means any evidence that you have partaken in or purchased the drug could affect your federal student loans, certain employment positions, and social benefits such as food stamps or public housing. Furthermore, drug offenses will always show up on your background checks.

I m 21 years old; could I share my weed with my 18-year-old brother?

No way. You cannot supply marijuana to anyone younger than 21 even if it s free and not for monetary compensation. Also, the zero-tolerance law means individuals under 21 face an automatic loss of their license if they are found driving under the influence of marijuana.

Can I resell the weed I bought legally?

No. You may, however, gift someone over 21 up to 1 ounce of marijuana as long as there s no exchange of money involved.

If my college roommate visits me from Alabama, do all these laws apply to him as well?

Only if he has a government-issued Colorado ID. Non-residents may purchase up to an ounce of marijuana per transaction, whereas they may possess one full ounce at a time. Essentially, your friend could make four different purchases in one day, but that s a gray issue where the consequences, or lack thereof, just aren t explicit so far.

Is there a legal limit for how much weed I can have in my system and still drive?

The legal limit is 5 nanograms or less of delta 9-tetrahydrocannabinol (THC, the active ingredient in marijuana) per milliliter in whole blood. This isn t a great measurement because different strains of marijuana carry different potencies of THC; also, people metabolize the drug at far more diverse rates than alcohol. For this reason, you ll likely never see a chart that tells you how many joints or brownies are too many to get behind the wheel.

How is the amount of marijuana in my body tested?

If they have a justifiable reason, law enforcement officials suspicious of drugged driving will request a blood draw. As this Westword article points out, however, these blood tests have not yet been refined and they can be rather inaccurate. In this case, the reporter s blood test showed that he was heavily stoned hours after he had last smoked anything. Other experts believe people build up a tolerance to the drug and they might still be sober at 5 nanograms. I urge you to highly consider refusing the blood test if the situation arises. If you do take the test, make sure you secure one of the blood samples to reaffirm the results independently later on.

You mean I won t have to pee in a cup?

A urine test has no value when it comes to marijuana because traces of the drug may show up in your system long after you re sober. A blood test is the only accurate indicator of active THC at the moment.

How long do the authorities have to conduct the blood test?

With alcohol, they must prove a person s BAC (blood alcohol content) is 0.08 percent or more within two hours of driving. They haven t issued a defined time period for drug testing yet but, rest assured, it will be something reasonable.

Will I lose my license if I refuse the blood test?

Possibly. As with DUIs, you could lose your license for a year if you refuse the blood test. Unlike drunk driving though, there won t be any administrative penalties on your record; this is important because marijuana consumption continues to be banned at the federal level. Remember, however, that you can always politely decline to do the standardized field sobriety tests (walking in a straight line, reciting the alphabet backwards, etc.) without penalty.

Why should I refuse to take a standardized field sobriety test?

In short, there are special tests designed for assessing drug intoxication and not every police officer is trained in those quite yet. Law enforcement officials uneducated in marijuana recognition certainly won t help your case as they don t have the resources to make an accurate judgment of your sobriety.

Wait, so will I be arrested if I have any traces of marijuana in my body?

No, the mere presence of cannabis in your blood is not a sufficient reason to arrest you. Furthermore, having 5 nanograms or more of marijuana in your system is not enough to automatically convict you of a DUID either; if you had a BAC of 0.08 percent or more, on the other hand, you would automatically be charged with drunk driving.

Everyone s saying marijuana is safer than alcohol; what s the danger in driving stoned?

Studies show marijuana consumption affects spatial perceptions, meaning drugged drivers have slower reaction times and tend to swerve or tailgate other vehicles more often. Think about those classic stoner movie scenes where the dudes are absolutely fascinated by the size of their hands; would you want them driving you down I-25?

I m a medical-marijuana user; does this make me an easy target for DUID checks?

It shouldn t. According to a Colorado bill, a person s medical-marijuana status (i.e., a valid medical-marijuana registry ID) cannot be used as evidence of impairment or probable cause for a blood test.

Can I at least drive around with marijuana products?

As with alcohol, it is illegal to drive with an open container of marijuana; doing so will result in a traffic infraction that shows up on federal checks (as I explained earlier). The law applies to anything containing marijuana that is open or has a broken seal, or has partially-removed contents. The best advice I can offer at this point is to keep it as far out of reach as possible. In fact, PUT IT IN THE TRUNK.

My car doesn t have a trunk.

Okay, as with all rules, there are certain exceptions. If you drive an SUV or minivan, you may keep unsealed marijuana behind the last row of upright seats. Open marijuana is also allowed in the living quarters of trailers or motor homes.

Can I smoke/consume weed in the car if I m not the driver?

No. People in the passenger area of a vehicle cannot use or consume marijuana, and the no open- container law applies to them as well. While we re at it, you also cannot smoke marijuana in a taxi or on public transportation. You may, however, smoke marijuana if you are in the rear of a privately-hired car.

As long as I buy the pot legally in Colorado, can I take it to other states?

Absolutely not–not even to Washington. Firstly, bear in mind the TSA is a federal institution and that marijuana is banned at all airports, including DIA. You cannot fly with the drug, and actually, you cannot even leave marijuana in your car at the airport; that would count as illegal possession and subject you to a heavy fine. Secondly, our neighboring states are cracking down on those driving into their borders with weed purchased in Colorado. Wyoming, for example, won t even recognize a Colorado-issued medical-marijuana card and will make arrests for illegal possession accordingly.

Four Russian stores hit with gas attacks

In Russia’s second largest city, St. Petersburg, four gas attacks left more than 70 people ill. Devices with wires, timers, and glass vials of a gas determined on scene to be methyl mercaptan were found in outlets of Makisdom, a home improvement chain store. The chemical is both naturally occurring and manufactured and is used as an oderant for detection of propane or natural gas leaks.

Store officials have said that they had received threats that sales would be disrupted before New Year’s. Russians traditionally give gifts on the holiday. Police officials said they believed a commercial dispute or a prank not terrorism.

The local emergency hospital was overflowed from the influx of ill people from the attacks. Valentina Matviyenko, Governer of St. Petersburg, said that those who sought medical help were not suffering any further medical problems.

A custodian at one of the stores found the devices and alerted police. The devices were found at another store with their vials broken. The devices in the two other stores were carried outside by employees and covered with buckets. The police explosives experts defused them.

Polish drug company Jelfa ordered to shut-down over mislabelled drugs

Polish Prime Minister Jaros?aw Kaczy?ski has ordered the pharmaceutical company Jelfa to halt production following revelations that Jelfa had placed mislabelled medication on the market, whose use could be potentially fatal.

Jelfa distributed vials labelled as Corhydron, a hydrocortisone used to treat allergies and inflammation, but in fact containing Suxamethonium chloride, a drug normally used to cause muscle paralysis during emergency surgery.

The Health Ministry has appealed to people suffering from asthma or allergies to check their medication and return any Corhydron ampoules they possess to the pharmacy.

Polskie Radio reports that the mislabelling was discovered a month ago, but Jelfa and the Polish Health ministry did not inform of the problem.

Prime Minister Jaroslaw Kaczynski ordered Jelfa to halt production until it can assure the Polish Government that it can properly manage its production.

The Polish Outlook reports that that drug companies in Poland were operating unregulated since December, 2005 as the regulations has expired. The government was putting in place new regulations.

The owner of Jelfa is AB Sanitas, the largest drug producer in neighbouring Lithuania. The shut-down has been questioned by the Lithuanian Prime Minister Gediminas Kirkilas, who expressed concern over the situation and said that he wants to try to settle the issue diplomatically.

County Donegal, Ireland crash kills one, injures two

A two-vehicle road traffic accident in County Donegal in Ireland has left one person dead and injured two others. The accident occurred when a camper van collided with an oncoming car on the N15 road between the towns of Ballybofey and Donegal at approximately 1540 BST (1440 UTC) on Monday.

The fatality was reportedly a man in his 70s from the town of Lifford; he has not yet been publicly identified. He was taken to Letterkenny General Hospital, where he was pronounced dead. The female passenger he was travelling in the car with, thought to be the wife of the man, was taken to the same hospital after suffering serious injuries.

The man and woman in the camper van were transported to Sligo Regional Hospital. The condition of the two occupants is not clear, although the woman in the vehicle reportedly injured her leg in the accident.

The road where the crash occurred was closed to allow the Garda to investigate the incident.

UK PM’s speechwriter awaits sentence

An English lawyer has pleaded guilty to perverting the course of justice. He faked a legal judgment and sent it to a father who was pleading in Taunton family court to be able to remain involved in his child’s upbringing. The lawyer, London barrister Bruce Hyman, now awaits his sentence. The judge indicated that he could receive a prison sentence. Bruce Hyman is well-known in media circles, having produced The Hitchhiker’s Guide to the Galaxy on BBC Radio. He also produced a series with Clive Anderson, at Above the Title Productions, called Unreliable Evidence.

The father, a former City financier, had attended a series of court hearings in order to make suitable arrangements to see his child following an acrimonious divorce. Shortly before one of these hearings he received an email, ostensibly from a self-help group to which he belonged, which had attached a Court of Appeal case that appeared favourable to an application he had made for the judge to stand down from the case. The father, who was representing himself, duly showed the case to the judge. At this point, Bruce Hyman, the lawyer representing the former wife, claimed to the judge that the case was a forgery, which indeed it turned out to be.

After confirming that the self-help group had not sent him the email, the father then embarked on some detective work his own. The fraudulent email was traced via its header to a dial-up internet connection and a phone number belonging to a shop in London. The shop was able to recover CCTV footage which showed a man sending the email from an Apple laptop. The man turned out to be Bruce Hyman.

Sentencing of Hyman is due in Bristol Crown Court on the 19th of September.

Virgin Media investors want to discuss company’s strategy

Virgin Media announced weak results last week, in part due to competition from Sky. Virgin Media lost 47,000 customers from January to March 2007, while Sky gained 51,000 customers in the same time period.

Franklin Mutual Advisers, which has 9.4% of the Virgin Media shares (Sir Richard Branson owns 11%) wants to have a meeting with Virgin Media about its “strategic direction, corporate governance and management”. Franklin Mutual Advisers is known to take great interest in the companies in which it invests.

This has caused many of the other investors of Virgin Media to demanding meetings with the management of the company. The demands are due to confusion among shareholders at the direction in which the company is heading, The Guardian reports. After the attempt to buy ITV was stopped last year, the shareholders think that Virgin Media may lose its battle with Sky and TalkTalk.

Another issue causing concerns amongst investors is the £25.2 million pay cheques for the top seven executives of Virgin Media. Virgin Media reported a £15.3 million loss last year.

IBEX satellite releases first all sky map

NASA’s IBEX (or Interstellar Boundary Explorer) satellite, released into orbit last October, has provided the data for the first “all sky map” showing the boundary between the Solar System and Interstellar Space. IBEX mapped the sky using two sensors, gathering information about the particle structure within the Milky Way. This map should help researchers better understand relationships between the Sun and our Galaxy.

The particles which IBEX looks for are energetic neutral atoms, atoms with a neutral charge that release large amounts of energy in most directions. The best place to find these particles is in the Sun’s Heliosphere, where forces from outside our solar system interact with the Sun’s magnetic field, causing these particles to become highly energetic. Two sensors on IBEX detect and catalog this. After six months of repeating this cycle over the entire night sky, IBEX acquired enough data to create the all sky map.

This map goes beyond the capacities of the Voyager missions, giving an insight into the Sun’s interaction with the rest of the galaxy. As Cosmic rays approach the solar system, the heliosphere prevents them from crossing into the heart of the solar system, thereby effectively stopping these harmful rays from reaching Earth. This new energy is released from electrically neutral atoms, and when scientists look at the energy given off by these atoms they have a general view of what energy is coming from what area.

Knowing the place in the galaxy where certain rays come from help scientists understand the way our galaxy functions, from star positioning to globular clusters. “For the first time, we’re sticking our heads out of the sun’s atmosphere and beginning to really understand our place in the galaxy,” said David J. Comas of NASA.

Consensus reached on incentive package for Iran

In Vienna, top diplomats from the United States, Russia, China, United Kingdom, France, and Germany reached an agreement on Thursday on an incentive package to offer to Iran in exchange for its giving up uranium enrichment.

The specifics of the incentive package were not revealed, but a delegation from Europe led by European Union foreign policy chief Javier Solana is expected to formally deliver the offer to Iran in the coming days. Iran would then have several weeks to respond.

In a prepared statement, British foreign secretary Margaret Beckett said, “We have agreed on a set of far-reaching proposals as a basis for discussions with Iran. We believe they offer Iran the chance to reach a negotiated agreement based on cooperation.”

Beckett did not mention any sanctions to be taken against Iran if it refuses to comply. The United Nations Security Council is expected to take up the question of sanctions should Iran turn down the offer.

The agreement comes a day after the United States offered to participate in multilateral negotiations with Iran over its nuclear program if Iran suspends its uranium enrichment program. Iran agreed to the idea of holding talks but rejected the preconditions.

In the first direct reaction by the Iranian government to the offer, Iranian foreign minister Manouchehr Mottaki said on Thursday; “Iran welcomes dialogue under just conditions but won’t give up our rights,” Iranian state-run television reported. “We won’t negotiate about the Iranian nation’s natural nuclear rights but we are prepared, within a defined, just framework and without any discrimination, to hold dialogue about common concerns,” he said.
