U.S. Supreme Court upholds health care mandate

In a decision today, the U.S. Supreme Court has upheld the controversial healthcare law, the Patient Protection and Affordable Care Act, passed in 2010. The Supreme Court also upheld the individual mandate provision of the law, which would require most U.S. citizens to obtain health insurance by 2014, or pay a monetary penalty.

The Supreme Court ruled on the law 5–4. Chief Justice John Roberts authored the majority opinion. Justices Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor jointed Roberts in the majority, while Samuel Alito, Anthony Kennedy, Antonin Scalia and Clarence Thomas were in the minority in supporting the repeal of the law.

The Court did, however, strike down a provision of the law which would have expanded Medicaid to make coverage available to anyone with an income less than 138% of the federal poverty line.

President Barack Obama made a public statement from the White House saying that the Supreme Court’s upholding of the law, “reaffirmed a fundamental principle that here in America — in the wealthiest nation on Earth – no illness or accident should lead to any family’s financial ruin.” Obama further added, “Whatever the politics, today’s decision was a victory for people all over this country whose lives will be more secure because of this law and the Supreme Court’s decision to uphold it.” Obama closed his statement by saying, “The highest Court in the land has now spoken. We will continue to implement this law. And we’ll work together to improve on it where we can. But what we won’t do — what the country can’t afford to do — is refight the political battles of two years ago, or go back to the way things were.” Adding, “With today’s announcement, it’s time for us to move forward — to implement and, where necessary, improve on this law.”

Republican presidential candidate Mitt Romney also gave a statement from Washington, D.C. saying, “What the Court did not do on its last day in session, I will do on my first day if elected President of the United States. And that is I will act to repeal Obamacare.” Romney clarified further by saying, “Let’s make clear that we understand what the Court did and did not do. What the Court did today was say that Obamacare does not violate the Constitution. What they did not do was say that Obamacare is good law or that it’s good policy.” Further adding, “Obamacare was bad policy yesterday. It’s bad policy today. Obamacare was bad law yesterday. It’s bad law today.” Romney closed by saying, “Our mission is clear: If we want to get rid of Obamacare, we’re going to have to replace President Obama.”

Eric Cantor, Republican leader in the U.S. House of Representatives, announced shortly after the ruling that the House would vote on repealing the law on July 11, following the July 4 holiday recess. Cantor said, “The Supreme Court’s decision to uphold Obamacare is a crushing blow to patients throughout the country. Obamacare has failed to keep the President’s basic promise of allowing those who like their health care to keep it, while increasing costs and reducing access to quality care for patients.”

In the ruling of National Federation of Independent Business v. Sebelius, John Roberts wrote, “Simply put, Congress may tax and spend. The federal government may enact a tax on an activity that it cannot authorize, forbid or otherwise control.” Meanwhile, Justice Anthony Kennedy authored the dissenting opinion, saying the entire law should have been repealed.

The ruling on the law comes after 26 states challenged the law in oral arguments in front of the Supreme Court in March.

Questions raised over Mosquito device ahead of New South Wales trial

A device known as the Mosquito, set to be trialed in New South Wales (NSW), Australia by RailCorp in a bid to deter vandals from areas frequently the target of graffiti, is attracting criticism. Wikinews reached out to several people about the trials.

The units work by emitting a high-pitched buzz, similar to that of a mosquito, which is generally only audible to those under the age of about 24. The aim is to repel young people who become irritated by the noise, as a prevention method against graffiti, loitering, and other crimes like theft.

The initiative was announced last month, but RailCorp has not revealed when it intends to test the technology to crack down on graffiti.

In an interview with Wikinews, President of the NSW Council for Civil Liberties Cameron Murphy this week labeled the strategy “ridiculous”. “All they’re going to do is wear headphones and these [devices] will make no difference at all.”

Thousands of units have been set up in the UK since they first became available about seven years ago, where they’re used to stop youths gathering near public areas like shops and train stations. The technology has a high usage rate in the UK, and the Council of Europe has called for a ban on grounds it violates human rights, calling it “highly offensive”.

A RailCorp spokesperson confirmed to Wikinews the devices would only be situated on railway land away from public areas.

Mr Murphy maintains the NSW government’s policy is “based upon discrimination” and it assumes the youth affected by the noise are those doing graffiti, without solid evidence to prove this.

NSW Liberal MP Gareth Ward told Wikinews, “very few crime fighting techniques are fool-proof,” and as people have found ways to get around CCTV, they’re like to do the same with this, which is why it’s only being trialed at this stage. He acknowledged the devices will be situated in areas where the general public shouldn’t be hanging around. “There are certain areas in the network where trains may not be travelling at a particular time and that’s when those devices will be turned on […] and I think that’s perfectly reasonable.” He remarked, “any young person who feels they’ve been aggrieved […] should feel free to contact the Minster for Transport.”

A mobile phone message tone based on the same mosquito sound has been touted as teacher-proof because teens should be the only ones able to hear it if it goes off during class.

Right-to-die activists reveal euthanasia for Dutch patient with severe dementia

Yesterday, it was revealed that a 64-year-old Dutch woman with severe dementia has become the first patient in the country to be euthanized after she became unable to consent. In the Netherlands, patients can request assisted dying if they are of sound mind. In this case, the woman — who is known to have been a long-time political supporter of assisted dying — signed a request for assisted dying while she was capable of doing so.

The woman was assisted to die in March according to Walburg de Jong, a spokesman for Right to Die-NL, a group that supports assisted dying. De Jong noted that it is an “important step” for euthanasia activists: “before, patients dying by euthanasia were at really very early stages of dementia, which was not the case with this woman”.

The Netherlands has had legal voluntary euthanasia since a change in the law which came into force in April 2002.

Congressman Cunningham admits taking bribes

U.S. Representative Randy “Duke” Cunningham (RCA) pled guilty today to conspiring to take bribes in exchange for using his influence as a member of the House Appropriations Committee to help a defense contractor get business. In total he pled guilty to one count of income tax evasion and four counts of conspiracy, namely mail fraud, wire fraud, bribery of public official and accepting bribes. U.S. District judge Larry A. Burns scheduled Cunnigham to be sentenced on February 27. He is facing up to 10 years in prison and nearly $500,000 in fines, as well as forfeiture of unspecified amounts of cash and property.

In the court hearing, Cunningham admitted to accepting “bribes in exchange for performance of official duties” between “the year 2000 and June of 2005”, taking “both cash payments and payments in kind” and following up by “trying to influence the Defense Department”.

The federal investigation against Cunningham was triggered by his sale of his California residence to defense contractor Mitchell Wade in late 2003. However, Wade never moved in and sold the house at a $700,000 loss three quarters of a year later. At the same time Wade’s company MZM won tens of millions of dollars in defense contracts. Subsequent investigations discovered more questionable business transactions, including interactions with the defense contractor ADCS. In his plea agreement he testified that, among other charges, he “demanded, sought and received at least $2.4 million in illicit payments and benefits from his co-conspirators in various forms, including cash, checks, meals, travel, lodging, furnishings, antiques, rugs, yacht club fees, boat repairs and improvements, moving expenses, cars and boats.”

Cunningham announced his resignation after the hearing. In a written statement released by his law firm O’Melveny & Myers LLP he declared “The truth is — I broke the law, concealed my conduct, and disgraced my high office. I know that I will forfeit my freedom, my reputation, my worldly possessions, and most importantly, the trust of my friends and family.”

Stage collapse at Christian rock concert

Over 40 people were injured, three of them seriously, after the auditorium floor collapsed at a church in Abbotsford, BC, Canada.

Around 9:20 pm PDT Friday night an approximated 900 square foot section of the stage and floor collapsed at a Starfield concert attended by as many as 1200 people at Central Heights Church. Reports from the concert goers indicate that sound and lighting scaffolds collapsed onto the front section of the stage and mosh pit, though it is not yet clear whether this was the cause of or the result of the floor collapsing into the basement 15 feet below.

Abbotsford Police Constable Casey Vinet stated that all available city police, fire and ambulance units responded to the scene, along with units from neighboring jurisdictions.
